Terms of Service

These Terms of Service ("Terms") govern your use of the Fitnass mobile application ("the App"), operated by Fahras, based in Ajman, United Arab Emirates. By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use Fitnass. By using the App, you confirm you meet this requirement.

2. The Service

Fitnass is a fitness and nutrition tracking app that helps you log workouts, meals, and body measurements, and provides AI-assisted meal scanning as part of its Pro subscription.

Fitnass does not provide medical advice. Nutrition and fitness information, goals, and recommendations shown in the App are for general informational purposes only and are not a substitute for professional medical, dietary, or fitness advice. Consult a qualified healthcare provider before starting any new diet or exercise program, especially if you have a pre-existing medical condition.

3. Subscriptions & Payment

Fitnass Pro is offered as an auto-renewing subscription (monthly or annual), billed through your Apple Account. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Manage or cancel your subscription anytime in your device's Settings → [Your Name] → Subscriptions. Payment is charged to your Apple Account at confirmation of purchase. Any unused portion of a free trial period is forfeited when you purchase a subscription, where applicable. Refunds are handled by Apple in accordance with their refund policies — we do not process refunds directly.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from within the App (Settings → Account → Delete Account).

5. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or extract the App's source code; (c) interfere with or disrupt the App's servers or networks; (d) upload content that is illegal, abusive, or infringes on others' rights.

6. Content You Submit

You retain ownership of photos, logs, and other content you submit to the App. By submitting meal photos for AI scanning, you grant us a limited license to process that image (including via third-party AI providers, as described in our Privacy Policy) solely to return nutrition information to you. Photos are deleted from our servers after processing.

7. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AI-generated nutrition estimates will be perfectly accurate.

8. Limitation of Liability

To the maximum extent permitted by law, Fahras shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to health outcomes resulting from reliance on App-provided information.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles.
